These terms govern the use of the Infinive Video Editor SDK (the “SDK”), including the iOS frameworkVideoEditorCore, the Android library show.infini:videoeditor, the Flutter packageflutter_video_editor_plugin, the license server and the website at infinive.dev (together, the “Service”). The Service is provided by Infinishow Inc. (“Infinishow”, “we”). By downloading, integrating or using the SDK you (the “Licensee”) agree to these terms.
1. License
Subject to these terms and to an Order Form signed by both parties, Infinishow grants the Licensee a non-exclusive, non-transferable, revocable license to integrate the SDK into the applications registered to the Licensee’s license key and to distribute the SDK as part of those applications to end users. Each license key is bound to specific application identifiers (iOS bundle identifiers and Android package names). Applications not registered to a key are not licensed.
The license is granted for the term stated in the Order Form. When the term ends and is not renewed, the SDK may stop opening the editor within seven days at most.
2. Restrictions
- The SDK may not be redistributed, sold, sublicensed or made available on its own, outside of a licensed application.
- The SDK, its binaries and its license mechanism may not be reverse engineered, decompiled, modified or circumvented, except to the extent that applicable law prohibits this restriction.
- License keys may not be shared with or used by third parties, or used in applications that are not registered to the key.
- The SDK may not be used to build a product that competes with the SDK by exposing its editing engine to other developers.
3. Fees
License fees are stated in the Order Form and are payable in advance for each term. Fees are non-refundable except where required by law. Infinishow may suspend a license key whose fees remain unpaid after the due date.
4. Trial keys
Trial keys are provided for evaluation in debug builds for a limited period. They may not be used in applications distributed to end users. Trial keys expire automatically and may be revoked at any time.
5. Third-party services
The sticker feature uses the GIPHY API with an API key supplied by the Licensee. Use of GIPHY is governed by GIPHY’s own terms. Infinishow is not a party to that relationship and is not responsible for GIPHY content or availability.
6. Intellectual property
The SDK, its documentation and all related materials remain the property of Infinishow. Media edited and exported by end users through the SDK belong to the Licensee or its end users; Infinishow claims no rights in that media and does not receive it.
7. Support and updates
Infinishow provides updates to the SDK at its discretion. Support is provided by email to licensees with an active contract. Infinishow does not guarantee that a given version of the SDK will remain compatible with future versions of iOS, Android or Flutter.
8. Warranty disclaimer
The SDK is provided “as is”. To the maximum extent permitted by law, Infinishow disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Infinishow does not warrant that the SDK will be error-free or that it will operate without interruption.
9. Limitation of liability
To the maximum extent permitted by law, Infinishow is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising out of or related to the SDK or these terms. Infinishow’s total liability under these terms is limited to the license fees paid by the Licensee for the twelve months preceding the claim.
10. Termination
Infinishow may terminate the license if the Licensee breaches these terms and does not cure the breach within fourteen days of notice. On termination the Licensee must stop distributing new builds that include the SDK. Builds already distributed to end users continue to operate until the license key expires or is revoked.
11. Changes
Infinishow may update these terms. The effective date at the top of this page indicates the current version. Material changes are communicated to licensees by email at least thirty days before they take effect, except where a change is required by law.
12. Audit rights
Infinishow has the right to verify that the Licensee uses the SDK in compliance with these terms and the license agreement. With written notice, and no more than once in any twelve-month period, Infinishow may review records showing which applications use the Licensee’s license keys and how those applications are distributed.
13. Confidentiality
The Licensee must keep strictly confidential the SDK’s non-public APIs, beta versions, license keys and any other information that Infinishow designates as confidential, and must not disclose them to third parties or use them for any purpose other than those permitted by these terms.
14. Privacy and data protection
The Licensee is solely responsible for the collection, processing and protection of its end users’ personal data, and must comply with all applicable data protection laws in doing so (including the GDPR, the CCPA and the Personal Information Protection Act of the Republic of Korea). This does not include the processing by Infinishow described in the Privacy Policy.
15. Force majeure
Neither party is liable for any failure or delay in performing its obligations under these terms caused by events beyond its reasonable control, such as natural disasters, war, terrorism, strikes or telecommunications failures.
16. Miscellaneous
- Entire agreement: these terms and the Order Form together constitute the entire agreement between the parties on their subject and supersede all prior agreements and understandings between them. If the Order Form conflicts with these terms, the Order Form prevails.
- Severability: if any provision of these terms is found invalid or unenforceable, the validity and enforceability of the remaining provisions are not affected.
- Waiver: a party’s failure to exercise or enforce any right or provision of these terms is not a waiver of that right or provision.
17. Governing law
These terms are governed by the laws of the Republic of Korea. Disputes are subject to the exclusive jurisdiction of the courts of Seoul, Republic of Korea.
